On January 27, Acting Attorney General James McHenry terminated the employment of about a dozen Department of Justice prosecutors who worked for Jack Smith, who was investigating Trump’s theft of classified documents and attempt to overturn the results of the 2020 election.
At this time, before several Supreme Court rulings that eroded protections for federal workers, the firings were legally dubious, in all likelihood illegal.
The justification for the terminations are as follows:
“Acting Attorney General James McHenry made this decision because he did not believe these officials could be trusted to faithfully implement the President’s agenda because of their significant role in prosecuting the President,” said the DOJ official, who wasn’t authorized to speak publicly.

It is not the job or purpose for Department of Justice employees to “implement the President’s agenda.”
