On March 5, Rep. Eric Swalwell filed a lawsuit against Donald Trump, Don Jr., Rudy Giuliani and Rep. Mo Brooks for inciting the January 6 attack on the Capitol. Today, reports surface that Trump campaign lawyer Jesse Binnall will represent the Trumps.

In addition to serving on the campaign’s legal team, Binnall is also closely associated with some of the most infamous faces of Trump’s election fraud claims. He previously worked with Sidney Powell in defending Michael Flynn after he was charged with lying to the FBI. Binnall continued to work with Powell on her Defending The Republic non-profit and Restore The Republic super PAC in recent months.

It’s unclear if Powell’s admission that election fraud claims were lies has impacted her ties with Binnall and other people close to Trump.

Swalwell’s lawsuit claims that the group conspired to violate the civil rights of the members of Congress gathered in the Capitol, to delay or prevent the certification of Joe Biden’s electoral win. It also charges the men under local DC law against inciting rioting and terrorism.

Binnall is also representing the elder Trump in a similar lawsuit filed against him, Giuliani, and members of the Proud Boys and Oath Keepers militia groups.
